About my Disclaimer…(a letter to Uncle Frank)

Hi All,

 

There is a disclaimer posted on my site.  I have a slightly different one in my CorporateVeil Pro product, but it too is written in English. 

 

You see, giving people legal advice when you are not a lawyer is not a good idea.  Even if you are a lawyer it can be a bad idea.  You can interpret what you believe to be true, and provide that information, but in the end people need to verify that the information is valid for their circumstances.

 

Some of the information I dispense may even be based on incomplete or incorrect facts, but that would be entirely inadvertent.  (You should never knowingly print lies, that is a form of fraud and it removes a lot of your protection.) 

 

In keeping with my thinking that things should be kept clear and concise, I’ve reprinted my website disclaimer below, it’s also in the column to your right, under my serious picture.

 

This disclaimer  is intended to protect me somewhat against someone taking some piece of information he or she read, implementing it, then not liking the results…

 

As an example, lets say I tell people that they need their own business, and they quit their job, start a business, and they go bankrupt in a year,  and then their mother-in-laws says “You Idiot, why would you start a business?” and the idiot says, “Some blogger guy said I should”, and that mother in law says “lets get Uncle Frank down at the Hair Care, Tire Repair and Legal Defense Center and we’ll sue that sucker”… (you get the picture)

 

So Uncle Frank, please calm your sister down and tell her to leave me alone, because…

 

An important legal disclaimer…

I am not a lawyer.

I am not licensed to practice law in any state, mine, yours, or any other.

I don’t even play one on TV.

So, I am NOT dispensing legal advice with this system.

Businesses are often different.

 Different states could have different laws which apply to your situation. 

You need to have a lawyer review your situation.  

I want to be clear on this point.

I do not replace the role of a lawyer as a vital part of your Professional Team.

I just help you use your lawyer more cost-effectively.  

 

 

 

A few questions to ponder…

Do you need a short disclaimer on your site? 

 

Could someone act on your information and decide to sue you? 

Do you need professional liability insurance in your business?

    Amen Brother. Good advice on having a disclaimer, and on people’s stupidity and tendency to blame their failures on someone or something else.

    Great post about disclaimers, in know that the Corporate Veil Pro system is going to help many many people save a lot of energy on setting up a business but your right it is absurd but people will blaim any one they possibly can for a law suit these days. Great advice

    What I appreciate is you talk in plain english about important things…dealing with business attorneys…piercing the corporate veil…and take a lot of the stress and anxiety out of dealing with the details that are so important.

    As far as the world being sue-happy…when will we start needing disclaimers for the disclaimers?

    PS: I think that the “Intuitive John” moniker is excellent and it is memorable in a good way. If it were me, I would use that site. For mow, you can setup the IntuitiveJohn site, get it working , and then just reidrect all the traffic from your name site to the IJ site…

    Rob,

    I am pondering the fact of whether a disclaimer matters. Placed at the bottom, gee I didn’t read that far. Placed at the top, I am turned off before I get to your stuff. Placed in the middle, didn’t see it. Seems like legal advice even though you say you are not a lawyer. I am going to sue you because you look rich in your picture.

    What I am trying to say is that disclaimers may or may not work. Contracts may or may not protect you. If you are successful, hungry sharks (oh did I say that, I meant lawyers) will find a way to sue you and if the judge got bit by the dog on the day that he decides your case, you may lose even if you have the best disclaimer or contract in the world.

    My point is the only way you can truly win in a lawsuit is to not be named a defendant. If your entity (corporation or LLC) has taken all of the correct steps including buying Corporate Veil Pro to have the most updated records as possible then you the person will not be party to the lawsuit or will be dismissed on motion right away. It will only be the entity that will be sued and at risk.

    Excellent point…

    I hear you and I want to discuss this more with you. I understand what you are saying. Since I’m not a lawyer I don’t know that answer. I guess a disclaimer can’t hurt and we need insurance and good records to handle the rest..

    The envious hordes want your assets…and sue-happy lawyers are out to help them out as much as they can.

    My favorite disclaimer comes at the beginning the show “South Park” Some people consider it lewd, crude and obnoxious. But they can laugh at themselves. Their disclaimer says:

    “All characters and events in this show –even those based on real people– are entirely fictional. All celebrity voices are impersonated … poorly. The following program contains coarse language and due to its content it should not be viewed by anyone.”
